Anyone knows the policy about using Twitch embeds on your website?
If streamers eg play copyrighted music, is the website who is embedding the Twitch stream also responsible for copyrights and can expect a claim?
I know its more a legal thing, but I guess important for so many of us to know!!
Anyone has this expertise?
I don’t believe the website is liable here. Since the website is just embedding another website.
Just the content creator. Exception might apply if it’s the content creators own website, but if the content creator is getting DMCA’ed they got bigger problems.
This is what I found with some legal notes…
" The Appeals court ruled that embedding a video that infringes on copyrighted material is not a violation of copyright law. For example, if you found an episode of The Simpsons on YouTube and embedded it in your blog, you would not be violating any copyright laws. That holds true even if the person who uploaded the video ripped it straight from The Simpsons season 3 DVD. However, the person who uploaded the video is in violation of the law."
This is about YouTube, I can imagine its the same thing at Twitch!
Currently we embed Twitch streams on RaidPal
When it comes to using Twitch embeds on your website, Twitch’s Terms of Service and Community Guidelines are important to consider. According to Twitch’s terms of service, you are allowed to embed Twitch streams on your website as long as you comply with their guidelines, which include giving proper attribution to the original streamer and not altering the content of the stream in any way.
Regarding copyrighted music, if the streamer plays copyrighted music during their stream, they may be liable for copyright infringement. However, it is unclear whether the website embedding the Twitch stream could also be held liable for copyright infringement. It is recommended to consult a legal expert to get a better understanding of the legal implications of embedding Twitch streams on your website, particularly with regards to copyrighted material.
In summary, while Twitch allows embedding of their streams on external websites, it is important to comply with their guidelines and consider potential copyright issues.
